Election-America, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) as set forth by the U.S. Department of Commerce. Election-America, Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern. E-A is responsible for the processing of personal data it receives, under the EU-U.S. Data Privacy Framework Principles, and subsequently transfers to a third party acting as an agent on its behalf. We comply with the EU-U.S. Data Privacy Framework Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.
With respect to personal data received or transferred pursuant to the EU-U.S. Data Privacy Framework Principles, we are subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. No collected data will be collected or shared without the expressed consent of the user. Customer data received or transferred pursuant to the EU-U.S. DPF, will exclusively be used in the execution and management of elections, nominations, surveys, and awards. Customer data shared with third-parties will be done only with the express consent of those customers. Individuals have the right to access their personal data.Individuals have the right to choose (opt out) whether their personal data is used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized. In compliance with the EU-U.S. DPF, Election-America, Inc. commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF.
In compliance with the EU-U.S. Data Privacy Framework Principles, individuals may have the option to invoke binding arbitration to address residual complaints not resolved by other means. This mechanism is available under specific conditions and serves as a final recourse for dispute resolution. For more information on the arbitration process and eligibility, please refer to Annex I of the EU-U.S. DPF Principles.
In compliance with the EU-U.S. DPF, Election-America, Inc. commits to resolve DPF Principles-related complaints about our collection and use of your personal information. This Privacy Policy (the "Policy") applies to all personal information received from consumers by E-A in the United States from the European Economic Area and from Switzerland, in any format including electronic, paper or verbal. Adherence by E-A to these EU-U.S. Data Privacy Framework may be limited (a) to the extent required or permitted by law or legal process, such as to respond to or investigate a legal or ethical obligation or request or pursuant to court orders, subpoenas, interrogatories or similar directive carrying the force of law; and (b) to the extent expressly permitted by an applicable law, rule or regulation.
For purposes of this Policy, the following definitions shall apply:
E-A works with several companies to help us deliver our services to you on our behalf. These companies provide services such as offering customer support, materials production, and sending emails on our behalf. In some cases, these companies will have access to some of your personal information in order to provide services to you on our behalf. They are not permitted to use your information for their own purposes. E-A will always secure client consent prior to granting access to such information.
The privacy principles in this Policy are based on the EU-U.S. Data Privacy Framework.
E-A uses reasonable physical, electronic, and administrative safeguards to protect your personal information from loss; misuse; or unauthorized access, disclosure, alteration, or destruction. E-A will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current. We will only collect and store personal information that is relevant to fulfill the purpose of the request and will retain such information no longer than appropriate to fulfill the purpose of the request.
This Policy may be amended from time to time, consistent with the requirements of the EU-U.S. Data Privacy Framework.
